Even though it's America, cases are won by balance of probabilities. The cup of hot coffee one was won on the basis that the coffee served was way higher than the normal temperature that was supposed to be served. That's tort, anyway.

Besides that, there's no way in hell P.Diddy will lose this case unless he pleads no contest or doesn't show up, which he might think of doing because it's so ridiculous that he just doesn't think much of it.
