I'm in Maryland, and I'm sure the smiling one is, as I've been to Jersey a few times. You can ask any cop, but whether or not they'll arrest you for something that stupid is a different story.

Most cops probably aren't even aware that these laws exist, and would not enforce them in most cases, even if they were aware of them.
